Hague Service of Process refers to the formal method of serving legal documents internationally under the Hague Service Convention, ensuring that court documents are properly delivered to a party located outside Canada. Any Ontario proceeding that requires serving documents on a party in China or another Hague Convention member country must follow this formal international service process.
For China, service is typically completed through the designated Central Authority process, which may involve submission through the appropriate Canadian forwarding authority, official transmission to Chinese judicial authorities, formal delivery by local court officers or designated agencies, and return of a certificate of service confirming completion. Due to China's formal processing requirements, many cases take approximately 3 to 8 months in total — and translation quality, completeness of documentation, and administrative backlog can all affect the timeline.
Mia He assists clients with cross-border service of legal documents from assessment through to filing, including: assessing whether Hague Service applies to the specific jurisdiction; preparing and organizing all required court documents for international service; ensuring proper formatting, certification, and translation requirements are met; coordinating submission through the appropriate Central Authority channels; monitoring the service process and following up on delays or rejections; and ensuring compliance with Ontario court filing requirements for proof of service.
Her approach focuses on reducing delays and ensuring that service is valid, enforceable, and procedurally compliant in both jurisdictions. As a Mandarin- and English-speaking lawyer licensed in both Ontario and China, she is particularly well placed to assist clients with service matters involving parties in China — including coordination of translation requirements and liaison with Chinese judicial processes.
Mia He has acted in matters involving international service of court documents where one party was located outside Canada, including in China and other Hague Convention jurisdictions. These matters typically require coordination of cross-border procedural rules, careful preparation of service packages, and strict compliance with both Ontario court requirements and foreign service protocols. In such cases, attention is focused on ensuring that service is properly validated, documented, and accepted by the receiving jurisdiction — so that procedural delays in ongoing litigation are avoided.
We provide Hague Service assistance to clients across Ontario, including cross-border litigation matters involving service of documents in China and other Hague Convention countries:
