Water leak incidents in Toronto condo buildings have been making headlines lately, and condo fees keep rising — so who exactly is responsible when a building floods? Do owners have to bear all the losses themselves?

Developer Liability: If the developer had design defects in the construction of the building, or used materials with quality defects, the developer may bear a degree of responsibility.

Property Management Company Liability: If the property management company was negligent in its day-to-day duties — failing to carry out proper inspections and maintenance — the management company may also bear responsibility. However, if a leak occurs under normal use conditions, it may be considered normal wear and tear.

What About Losses Inside the Owner’s Unit? Many owners have had their floors damaged by water and may need to replace them, which can be a significant expense. If you have already purchased your own condo owner’s insurance, you can file a claim with your insurance company.

This is exactly why, even though the building already has its own insurance, we still recommend that owners purchase their own personal condo insurance — the building’s insurance only covers the common areas of the building and does not cover losses inside your individual unit. In the event of theft or other incidents, you can file a claim with your own insurer. We strongly encourage all condo owners to purchase their own insurance as soon as possible.
